General conditions of sale

1. Acceptance of the quote and confirmation of the order
The quote issued by SAS Write is valid for a period of 15 days. After this period, pricing conditions are subject to change. The production launch date is determined by receipt of the signed proof of proof (BAT), along with the first 50% deposit.

2. Payment conditions and additional charges
Payment of the 50% deposit is required at the time of validation of the quote. The balance will be payable upon receipt of the second invoice, communicated by email once the order has been delivered by the selected carrier. (Transfer to IBAN: FR76 1695 8000 0139 4306 7059 821 | BIC/SWIFT: QNTOFRP1XXX). SAS Write reserves the right to charge additional fees for additional proofs (from the third proof requested, an additional €50 excluding VAT per edition is charged) or graphic services (assistance in creating the .ai customization file for an additional €50 excluding VAT). The customer agrees to pay all applicable taxes, including VAT or other similar taxes, resulting from the purchase of the products.
Payment is due no later than the 15th day following the invoice date (C. Com. art. L. 441-6, al.2 amended by the law of 15 May 2001). Any late payment may give rise to late payment penalties payable without reminder, at the rate of 10% of the total invoice per month of delay (Fight against late payments/article 53 of the NRE Law), as well as a fixed compensation of €40 (C. Com. art. D441-5). In the absence of non-payment, no claim will be taken into account.

3. Receipt of products and management of complaints
The Customer is required to carefully and immediately inspect all Products upon arrival and to promptly report any defects, non-conformities or damages via the Proof of Delivery document or the Acceptance Slip when the Products have been shipped under a POD (Proof of Delivery) or similar service. A description of the reported defect, deficiency or damage must be provided in writing at the time of delivery and signed by the Customer or an authorized representative.
In the absence of POD service, any claim for major defects must be submitted within 48 hours, accompanied by photographic evidence to professionnels@write-store.com. Subject to proof of non-compliance, a refund of up to 50% of the amount paid will be granted. If the refund reaches 50%, the remaining balance will not be required. However, if the customer fails to notify SAS Write in a timely manner (upon delivery of the package under a POD service or within 48 hours in the absence of a POD service), this will result in the cancellation of the product warranty.
SAS Write will deliver between 100% and 110% of the quantities ordered to compensate for any defects or shortages, thus minimizing the need for compensation.

4. Origin of products and quality
To offer competitive prices, SAS Write has chosen to outsource the production and shipping of pencils to a Chinese factory selected for its production quality and respect for its employees in accordance with Chinese labor legislation "Labor Law of the People's Republic of China" (information transmitted by the intermediary who handles the logistics of our orders on site).

5. Use as commercial references
SAS Write reserves the right to mention its work for the client company as a commercial reference through the use of its name or logo. The visuals of personalized products may be used on the website, in external communications and advertising by SAS Write. The client is responsible for ensuring that they have the necessary rights to use the visuals and texts provided for personalization.

6. Delivery, transfer of risk and applicable law
Products will be packaged using SAS Write's standard methods and shipped to the address specified by the customer. Any delivery time indicated is an estimate.
The customer accepts that the risk of loss and ownership of the products are transferred to him upon delivery of the products to the carrier (C. Com. art. L. 132-7).

7. Limitation of liability
Some countries provide warranties, such as the implied warranty of merchantability, fitness for a particular purpose, and non-infringement. To the extent permitted by law, SAS Write disclaims all warranties and assumes no liability. In no event shall SAS Write, its licensors, suppliers, service providers, and their representatives be liable for any indirect, consequential, special, or punitive damages, including, but not limited to, loss of profits, revenue, data, or other financial loss arising out of the use of or inability to use the products or services provided.
Under no circumstances shall SAS Write's total liability, whether in contract, tort (including negligence), or otherwise, exceed 50% of the total amount paid by the customer (percentage based on the quoted price) for the relevant products or services. This is to ensure that the costs associated with the production, delivery, support, and other services offered by SAS Write are covered.
This limitation of liability applies to the fullest extent permitted by applicable law and does not apply in the event of willful misconduct by SAS Write.

8. Right of withdrawal
In accordance with Article L121-21-8 of the French Consumer Code, the right of withdrawal does not apply to personalized products ordered from SAS Write. Only the following non-personalized products benefit from the legal right of withdrawal:
- Rechargeable mines
- Colored mines
Customers purchasing these products as consumers have 14 days following receipt of the order to exercise their right of withdrawal. To do so, an email must be sent to professionnels@write-store.com, with the order details. If the right of withdrawal applies, returns are at the customer's expense and risk. Once the products are returned and checked intact and in their original packaging, SAS Write will refund the purchase price paid for the returned products, excluding the initial shipping costs and any associated return fees, within 30 days.
